TITLE 1 GRIEVANCE AND APPEAL PROCEDURE

 

 

Purpose

 

To provide a means whereby any member of a parent advisory council, parent, teacher or other concerned individual may secure a hearing without unnecessary delay and be assured of a prompt, orderly and fair response to a grievance or appeal concerning violations of Title 1, or of applicable provisions of the general education Provisions Act in connection with programs under Title 1.

 

Policy

 

It is the policy of the Lincoln Parish Title 1 that every concerned individual or group has the right to present a grievance or appeal.  Every effort will be made to settle all grievances as quickly and as equitably as possible at the earliest stage after a grievance has been received.

 

Procedure

 

The Lincoln Parish Title 1 program has established the following procedures for filing a grievance by any individual or group who may have a concern relative to violations of Title 1.

 

  1. Complaints concerning a student or violation of Title 1 regulations will be made to the Title 1 classroom teacher who will strive to resolve the problems that may arise at each school site within five (5) days.
     

  2. The teacher will notify the principal of procedures she has utilized to resolve complaints.  The principal will take whatever action deemed necessary to reach a solution within ten (10) days.  At this point, usually all complaints are resolved.
     

  3. If the principal cannot resolve the problem, he will inform the Title 1 Administrative Supervisor of the complaint made and steps taken to resolve same within fifteen (15) days.
     

  4. If there are complaints by the advisory council and public regarding general operation of Title 1, the Administrative Supervisor will take necessary action to resolve the problem within five (5) days.
     

  5. The Administrative Supervisor will inform the Superintendent and administrative staff of the problems confronting the LEA and request their assistance, if needed, within ten (10) days.
     

  6. The Superintendent will inform the Board of complaints and ask for a public meeting whereby an opportunity for the complainant or the complainant's representative, or both, present evidence, including an opportunity to question parties involved.  Resolution of the problem should be made within twenty (20) days.
     

  7. If the problem cannot be resolved at the local level within thirty (30) days, the Superintendent and the Lincoln Parish School Board (LEA) will refer the complaint to the State Department of Education (SEA) who will comply with the SEA procedures as set forth in P.L. 95-561-Nov. 1, 1978, Sec. 168, "Complaint Resolutions," p. 34.
     

  8. The right to appeal the final resolution of the LEA to the SEA within thirty (30) days after receipt of the written decision is provided.
     

  9. If the SEA cannot resolve the complaint, it will be referred to the Commissioner in Washington who will comply with the procedures set forth in P.L. 95-561-Nov. 1, 11978, Sec. 184, "Complaint Resolution," p. 39.
     

  10. The LEA complaint procedures, along with "Notice of  Commissioner's Procedures for Resolving Complaints," as printed in the Federal Register/Vol. 44, No. 2061, Tuesday, October 23, 1979/Notices will be disseminated to the Board, superintendent, administrators, and the Title 1 teachers in each target school, district and school advisory council members, as required in Section G.
     

  11. Each school receiving this notice shall post a copy on the bulletin board or at a similarly conspicuous place in the school.
     

  12. Distribution of this notice will be made at local and district advisory council meeting.
